Of all the homeless people I have come across grubbing for money I never had such a specific request, " vitamin water", must be an upper west side thing.
Personally I think the women is a ditz (and mostly probably a democrat, a very liberal one too
) Why anyone would lend their credit card to someone they do not know, regardless of homelessness or not is beyond me. Yea, she was smart enough to check the account after the fact, but this story could have easily been a horror story for her. She had such a bleeding heart she should have went to the store bought him his vitamin water, some eats and nicotine patches to eliminate the need for cigarettes in the future, heck you need a platinum card to buy a pack in NYC anyway.

Who's the idiot clerk that rang up a homeless man with an AmEx Platinum card with a woman's name on it?
Could she really claim fraud if he rang up tons of crap on it?That which does not kill me, better start fucking running.

That was my first thought too, but then it occurred to me that in many retail stores you swipe your credit/debit cards yourself. I've used a card with someone else's name on it and was never questioned.
If she willingly gave him the card she would have to be liable for anything he charged, wouldn't she?
We could experiment - why don't you give me your credit card and I'll charge a bunch of stuff, then you claim fraud but I'll have witnesses say that you willingly gave me the card to buy brownie ingredients and in order to get the finest ingredients for you I needed a new HDTV, a Droid, and a trip to Hawaii.

If she gave him the card to use...even if he rang up her entire limit...then she is out of luck...he did not steal it or use it under false pretenses...he had PERMISSION to use it. Stupid stupid woman.
