ANAHEIM, Calif -- A newborn girl was found alive Monday in a bathroom trash can in a restaurant near Disneyland and a tourist believed to be the infant's mother was held for questioning, police said.

A customer at the Denny's restaurant at 1168 W. Katella Ave. found the baby around noon and called 911. The newborn was taken to to Western Medical Center in good condition, then placed in protective custody, said Anaheim police Sgt. Rick Martinez.

"The child appears to be doing well," he said.

Police at the scene saw a 17-year-old girl standing outside the restaurant with blood on her clothes. The teen from Indiana denied giving birth, but police took her to the same hospital for an exam.
The girl, who was with another teen believed to be her boyfriend, and his parents were being questioned by investigators, Martinez said.

No arrests were made, but the girl could face criminal charges, the sergeant said.

California and 46 other states allow parents to legally abandon a child at a hospital or other designated safe zones within 72 hours of birth, no questions asked.

Um hello... how do you travel with a girl who is 9 months preg. and not notice that she has blood all over her and no baby? And I am sorry, the girl was not a "big" girl...

There is no excuse for her. Especially when she could have taken the baby to the hospital. How utterly selfish!

Either way, all the safe surrender law does is protect you from prosecution for child abandonment.

Teen Mother of Baby Found at Denny's Faces Charges
Boyfriend's Mother Found Baby in Restroom

ANAHEIM, July 17, 2007 - The teenage mother of a baby found at a Denny's in Anaheim has been formally charged.

Police say the 17-year-old girl from Indianapolis was still in the hospital Tuesday. She will be taken into custody once she is released and she is facing felony charges.

"She remains in the hospital but she has been charged with felony child abuse and felony child neglect," said Sgt. Rick Martinez, Anaheim Police Department.

Police allege the teenager was eating lunch with her boyfriend and his parents at a Denny's restaurant in Anaheim when she got up to go to the restroom, where authorities allege she gave birth and abandoned the newborn girl in the trash bin.

"Who knows what could have potentially happened, but that child was in a life-threatening position," Martinez said.

Police say after questioning witnesses, they allege her boyfriend's mother discovered the baby and called 911.

Authorities say the baby is doing well at the hospital.

"Our investigation has shown that nobody else in the group possibly knew what was taking place or was aware of any pregnancy. We're pretty confident that just the young lady was aware," Martinez said.

Authorities say the case acts as a reminder of California's Safe Surrender program, allowing a parent to surrender a baby that's 72 hours old or younger at any fire station or hospital without fear of prosecution.

"There are placards in front of the station, English, Spanish and Vietnamese. They're available to provide that information. And I just think that just like anything else, it's education, we need to get the word out, and unfortunately, people listen when you have a situation like this, is when people usually pay attention," said Maria Sabol, Anaheim Fire Department.

Officials say as of January 2007, more than 180 newborns were safely surrendered in California. However, nearly 150 infants were found alive, but they had been illegally abandoned.
