Man threatens officer with painted flare gun

VISTA – A 56-year-old man was arrested early Sunday morning after aiming what looked like a black handgun at an off-duty sheriff's deputy, the Sheriff's Department reported.

The deputy had just gotten off work and was driving on Ascot Drive just west of North Melrose Drive when an orange 1984 BMW pulled up beside him about 5:45 a.m. and its driver aimed the weapon at him, said Lt. William Donahue.

The deputy called for backup, “which responded pretty quickly,” Donahue said. They found the BMW a short distance away, parked behind a retaining wall, with the driver drinking a beer, he said.
They also found the weapon, a loaded flare gun that had been painted black to look like a regular pistol, the lieutenant said.

The driver was booked into Vista Jail on suspicion of assault with a deadly weapon and driving under the influence.
